March 21, 2025 | Washington, D.C. — OpenAI, the creator of ChatGPT, has formally urged the Biden administration to relax copyright laws, advocating for expanded rights to train artificial intelligence models on copyrighted content. The San Francisco-based company argues that loosening restrictions is essential to preserving America’s technological edge against competitors like the People’s Republic of China (PRC).
In a detailed proposal submitted to the U.S. Department of Commerce, OpenAI calls for policies that would ease regulatory burdens on AI companies, framing the move as critical to safeguarding U.S. national security and maintaining its AI leadership.
OpenAI Targets Copyright Reform to Sustain AI Leadership
The company behind ChatGPT and DALL·E stated that existing U.S. copyright laws are stifling innovation. Sam Altman, CEO of OpenAI, stressed that the ability to train AI on diverse datasets — including protected content — is a competitive necessity.
“By allowing fair use of copyrighted material, we can protect creators while also securing America’s lead in the global AI race,” Altman said, indirectly referencing growing threats from China’s AI sector, particularly players like DeepSeek, Baidu, and Tencent AI Lab.
A Clash Between Silicon Valley and Washington
The proposal comes amid sharp debate between Silicon Valley tech giants and policymakers in Washington, D.C. over how to regulate artificial intelligence. The Biden administration’s 2023 executive order, titled “Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence,” emphasized mitigating risks like misinformation, disinformation, and data misuse.
However, OpenAI contends that stringent rules could stall private sector innovation, leaving the U.S. vulnerable to falling behind countries like China and Russia in the AI race.
Copyright Battles Intensify
The plea follows a wave of lawsuits against OpenAI from major media outlets, including The New York Times, The Center for Investigative Reporting, The Chicago Tribune, and The New York Daily News. Additionally, notable authors such as Sarah Silverman and groups representing visual artists have sued OpenAI and rival company Anthropic over alleged misuse of copyrighted works.
Despite the legal challenges, OpenAI maintains that AI training on publicly available and copyrighted materials aligns with “fair use” principles under U.S. intellectual property law.
The Stargate Initiative: A $500 Billion AI Bet
OpenAI’s proposal also references the massive Stargate project, a multi-billion-dollar collaboration between OpenAI, Oracle, and SoftBank, unveiled in partnership with the White House earlier this year. The initiative aims to build AI supercomputing infrastructure across 16 U.S. states, including Virginia, Texas, Ohio, and Arizona.
Mira Murati, Chief Technology Officer at OpenAI, highlighted that the Stargate infrastructure will “prepare an AI-ready workforce” and modernize U.S. energy grids, while bolstering domestic AI research capabilities.
DeepSeek R1 and China’s Growing AI Threat
OpenAI’s proposal explicitly points to DeepSeek R1, a model developed by a Chinese AI lab, which temporarily overtook ChatGPT as the top-ranked AI app in the Apple App Store earlier this year. The rise of DeepSeek rattled Silicon Valley and caused stock dips across AI-focused tech companies, including Nvidia, Palantir, and C3.ai.
“China is narrowing the gap. DeepSeek R1 is proof,” the proposal cautions, underlining AI’s evolving role in U.S.-China strategic competition.
Exporting “Democratic AI” Abroad
The document further urges Congress and federal agencies like the National Institute of Standards and Technology (NIST) to promote “democratic AI” globally. OpenAI advocates for exporting American AI frameworks to counter the spread of authoritarian AI models, especially in regions like Southeast Asia, Africa, and Latin America.
ChatGPT Gov: AI in Public Sector Operations
As part of its push for broader adoption, OpenAI highlighted the launch of ChatGPT Gov, a secure AI platform tailored for U.S. government agencies, including federal, state, and local administrations.
The Road Ahead
The Biden administration is expected to release a revised AI Action Plan later this year, balancing innovation incentives with content creator protections and AI transparency mandates. Meanwhile, advocacy groups such as the Authors Guild and The American Federation of Musicians are pressing for tougher safeguards against unauthorized use of intellectual property in AI model development.
